Karen Read asked Massachusetts' highest court to dismiss two of the three criminal charges she faced in connection with the death of John O'Keefe.

The state's top court ruled Tuesday that Karen Read can be retried on all previous charges in the death of her boyfriend, Boston police officer John O'Keefe. The court rejected her attorneys' bid to dismiss two of the three counts.

Karen Read's lawyers have argued since July that she should not be retried for 2nd degree murder. But justices on the state's highest court disagreed.

Read's lawyers have been battling to dismiss her second-degree murder charge and leaving the scene of a deadly crash charge for double jeopardy reasons.

The ruling clears the way for the Commonwealth to prosecute Read on all three charges of second-degree murder, leaving the scene of a crash, and manslaughter come retrial in April.
