Hecox want the Supreme Court to decide whether West Virginia’s and Idaho’s laws restricting transgender student participation violate the equal protection clause of the 14th Amendment and Title IX, the federal law that bars sex-based discrimination.

The cases involve laws in Idaho and West Virginia that bar transgender athletes from participating in women’s and girls’ school sports.

The decision by the liberal-leaning majority of the court marks the end of a three-year battle over abortion in the state after the U.S. Supreme Court overturned Roe v. Wade in 2022, nullifying federal abortion protections and kick-starting a fight over whether the Supreme Court decision effectively reactivated the state’s 1849 ban.
